Effect of placement on a Giglio list on the employment of a law enforcement officer
As added by P.L.93-2025, SEC.1.
(a) A law enforcement agency that employs an affected law enforcement officer may not:
- (1) demote;
- (2) suspend;
- (3) terminate; or
(4) impose discipline upon;
a law enforcement officer because the law enforcement officer's name was placed on a Giglio list.
- (b) A law enforcement officer may be subject to discipline, demotion, suspension, or termination if the facts underlying the reason for placement on a Giglio list are established in a disciplinary proceeding.
