1. (a) This section applies to criminal actions.

2. (b) The clerk shall collect the marijuana eradication program fee set by the court under IC 15-16-7-8 , if:

   1. (1) a weed control board has been established in the county under IC 15-16-7-3 ; and
   2. (2) the person has been convicted of an offense under IC 35-48-4 in a case prosecuted in that county.

3. (c) The court may set a fee under this section of not more than three hundred dollars ($300).
