A person who, under this chapter:

1. (1) has been aggrieved by a decision of the attorney general; or
2. (2) has filed a claim that has not been acted upon within ninety

3. (90) days after its filing;

   may maintain an original action to establish the claim in a court with jurisdiction and name the attorney general as a defendant.
