Ind. Code § 32-25-2-4

"Common areas and facilities"

As added by P.L.2-2002, SEC.10.

"Common areas and facilities", unless otherwise provided in the declaration or lawful amendments to the declaration, means:

  1. (1) the land on which the building is located;
  2. (2) the building:

    1. (A) foundations;
    2. (B) columns;
    3. (C) girders;
    4. (D) beams;
    5. (E) supports;
    6. (F) main walls;
    7. (G) roofs;
    8. (H) halls;
    9. (I) corridors;
    10. (J) lobbies;
    11. (K) stairs;
    12. (L) stairways;
    13. (M) fire escapes;
    14. (N) entrances; and
    15. (O) exits;
  3. (3) the:

    1. (A) basements;
    2. (B) yards;
    3. (C) gardens;
    4. (D) parking areas;
    5. (E) storage spaces;
    6. (F) swimming pools; and
    7. (G) other recreational facilities;
  4. (4) the premises for the lodging of:

    1. (A) janitors; or
    2. (B) persons in charge of the property;
  5. (5) installations of central services, such as:

    1. (A) power;
    2. (B) light;
    3. (C) gas;
    4. (D) hot and cold water;
    5. (E) heating;
    6. (F) refrigeration;
    7. (G) air conditioning; and
    8. (H) incinerating;
  6. (6) the:

    1. (A) elevators;
    2. (B) tanks;
    3. (C) pumps;
    4. (D) motors;
    5. (E) fans;
    6. (F) compressors;
    7. (G) ducts;
    8. (H) apparatus; and
    9. (I) installations;

      existing for common use;

  7. (7) community and commercial facilities provided for in the declaration; and
  8. (8) all other parts of the property:

    1. (A) necessary or convenient to its:

      1. (i) existence;
      2. (ii) maintenance; and
      3. (iii) safety; or
    2. (B) normally in common use.
