Except as provided in section 9 of this chapter, a governmental entity shall not require that a residential onsite sewage system be inspected or tested:

1. (1) in connection with, or as a condition of:

   1. (A) the sale of; or

   2. (B) the transfer of title to;

      a property containing the residential onsite sewage system; or

2. (2) as a prerequisite to the recording of a deed to the property containing the residential onsite sewage system.
