A proceeding may not be commenced under section 4 of this chapter if:

1. (1) an action for dissolution of marriage filed under IC 31-15-2-4 (or IC 31-1-11.5-3 (a) before its repeal) is pending; or

2. (2) a provisional order or decree based on a petition for dissolution of marriage filed under IC 31-15-2-4 (or IC 31-1-11.5-3 (a) before its repeal) has been granted.
