A person who recklessly:

1. (1) tampers with or damages a marking device, ballot, or other record or equipment used in an election;
2. (2) interferes with the correct operation of such a device or equipment; or

3. (3) interferes with the secrecy of voting;

   commits a Level 6 felony.
