1. (a) As used in this chapter, "licensee" means a person that is:

   1. (1) licensed, authorized to operate, or registered; or

   2. (2) required to be licensed, authorized to operate, or registered;

      under this title and the rules adopted under this title.

2. (b) The term does not include any of the following:

   1. (1) A purchasing group or risk retention group that is chartered and licensed in another state.

   2. (2) A person that is:

      1. (A) acting as an assuming insurer; and
      2. (B) domiciled in a state or jurisdiction other than Indiana.
