The commissioner may do the following to implement this article:

1. (1) Adopt rules under IC 4-22-2 .

2. (2) Enter into a contract, agreement, or memorandum of understanding with the following:

   1. (A) A health benefit exchange.
   2. (B) An entity that contracts with, or is a subcontractor of, a health benefit exchange.
   3. (C) A federal or state agency.
   4. (D) A health benefit exchange operating in another state.
   5. (E) An agency of another state.
   6. (F) A health plan.
   7. (G) Another person, for purposes of the performance of necessary functions, as determined by the commissioner.

3. (3) Enter with a person described in subdivision (2) into an information sharing agreement:

   1. (A) that concerns the disclosure and receiving of data necessary to implement this article or PPACA; and

   2. (B) that:

      1. (i) includes adequate protections with respect to confidentiality of the shared information; and
      2. (ii) complies with applicable state and federal law.
