"In-plan covered services" means the following:

1. (1) Covered health care services that are obtained from a provider who:

   1. (A) is employed by;
   2. (B) is under contract with;
   3. (C) provides health care services to an enrollee referred by; or

   4. (D) is otherwise affiliated with;

      the health maintenance organization.

2. (2) Emergency services.
