1. (a) As used in this chapter, "cosmetic surgery" means any procedure that:

   1. (1) is directed at improving the patient's appearance; and

   2. (2) does not meaningfully:

      1. (A) promote the proper function of the body; or
      2. (B) prevent or treat illness or disease.

2. (b) The term does not include the following:

   1. (1) A procedure that is necessary to ameliorate a deformity arising from or directly related to a:

      1. (A) congenital abnormality;
      2. (B) personal injury resulting from an accident or trauma; or
      3. (C) disfiguring disease.
   2. (2) A procedure related to the treatment of breast cancer.
