As used in this chapter, "foreign entity" means:

1. (1) a foreign government;
2. (2) one (1) or more individuals who are not United States citizens or permanent residents;

3. (3) an organization that:

   1. (A) is an instrumentality of; or

   2. (B) is controlled by;

      a foreign government; or

4. (4) an organization with regard to which five percent (5%) or more of the:

   1. (A) fair market value;
   2. (B) market capitalization; or

   3. (C) total voting rights;

      are owned by a foreign government, by an individual described in subdivision (2), by an organization described in subdivision (3), or by any other entity organized under the laws of a foreign government.
