As used in this chapter, "consumer genetic testing provider" or "provider" means a person that, in the ordinary course of the person's business:

1. (1) offers consumer genetic testing; or

2. (2) collects, uses, or analyzes genetic data that:

   1. (A) results from a consumer genetic testing product or service; and

   2. (B) is provided to the person by a consumer;

      in exchange for consideration.
