Any offeror, before making a takeover offer, shall:

1. (1) file any required statements with the commissioner in compliance with sections 5 and 5.5 of this chapter; and

2. (2) not later than the filing date of the statements, deliver a copy of each statement to the president of the target company at its principal office.
