1. (a) Except as provided in subsection (b), the sale of:

   1. (1) a cemetery;
   2. (2) any part of a cemetery; or

   3. (3) any personal property related to a cemetery;

      by a cemetery owner to a purchaser is subject to the conditions set forth in section 2 of this chapter.

2. (b) The sale of burial rights, services, or merchandise to an individual for the interment of the individual or members of the individual's family is not subject to the conditions set forth in section 2 of this chapter.
