If a crematory authority:

1. (1) refuses to file or neglects to file an annual report under section 24 of this chapter;
2. (2) fails to comply with the registration requirements under section 22 of this chapter; or

3. (3) refuses to comply with the record inspection requirements under section 25 of this chapter;

   the board may maintain an action in the name of the state of Indiana to enjoin the crematory authority from performing cremations.
