Note: This version of section effective until 1-1-2018. See also following repeal of this chapter, effective 1-1-2018.

1. (1) at the time of filing on the date it is filed, as evidenced by means the secretary of state uses for endorsing the date and time of filing on the original document; or
2. (2) at such later time on the date it is filed as is specified in the document as its effective time on the date it is filed.
3. (b) A document may specify a delayed effective time and date, and if it does so the document becomes effective at the time and date specified. If a delayed effective date but no time is specified, the document is effective at 12:01 a.m. on that date. A delayed effective date for a document may not be later than the ninetieth day after the date it is filed.

4. (c) A document that:

   1. (1) has been submitted to the office of the secretary of state; and

   2. (2) has a specified delayed effective time and date;

      may be withdrawn from the record before the effective time and date. The office of the secretary of state must receive written notice before the effective time and date from the person authorized to make the filing directing that the filing be withdrawn and not take effect. If the office of the secretary of state does not receive written notice, the document will become effective at the specified time and date.

Sec. 4. (a) Except as provided in subsection (b) and section 5(c) of this chapter, a document accepted for filing is effective:
