As used in this chapter, "subcontractor" means a person that:

1. (1) is a party to a contract with a contractor; and

2. (2) provides services or work for work the contractor is performing under either of the following:

   1. (A) A public contract for services.
   2. (B) A contract for a public works project with a public agency.
