As used in this chapter, "contractor" means a person that satisfies either of the following:

1. (1) Is a person that:

   1. (A) has entered into; or

   2. (B) is attempting to enter into;

      a public contract for services with a state agency or political subdivision.

2. (2) Is a person that:

   1. (A) has entered into; or

   2. (B) is attempting to enter into;

      a contract for a public works project with a public agency.
