1. (a) Except as provided in subsection (b), an issuing officer may issue an employment certificate only to a minor whose employment is necessary and only after receipt of the following two (2) documents:

   1. (1) Proof of age as set forth under section 18 of this chapter.
   2. (2) Proof of prospective employment as set forth under section 19 of this chapter.

2. (b) This subsection applies to a student who attends a nonaccredited nonpublic school. An issuing officer shall issue an employment certificate only after receipt of the following two (2) documents:

   1. (1) Proof of age as set forth under section 18 of this chapter.
   2. (2) Proof of prospective employment as set forth under section 19 of this chapter.
