A state educational institution that:

1. (1) exists as an instrumentality of the state in the form of a body corporate, body politic, or body corporate and body politic; and

2. (2) controls a postsecondary SEI affiliated educational institution;

   is considered to be a governmental entity equivalent to the state for purposes of United States Department of Education regulations.
