This chapter applies to an individual who:

1. (1) is receiving foster care;
2. (2) is in grades 9 through 12; and

3. (3) is a resident of Indiana as determined under IC 21-18.5-4-8 ;

   at the time the individual applies for the twenty-first century scholars program under IC 21-12-6 .
