Ind. Code § 20-33-8-22

Effectiveness of statute during judicial review

As added by P.L.1-2005, SEC.17.

An expulsion that has been upheld by a governing body continues in effect during judicial review under section 21 of this chapter unless:

  1. (1) the court grants a temporary restraining order under the Indiana Rules of Civil Procedure; and
  2. (2) the school corporation was given the opportunity to appear at the hearing regarding the temporary restraining order.
