Ind. Code § 16-46-18-5

Requirements

  1. (a) An organization or entity that establishes and administers a program shall do the following:

    1. (1) Subject to section 6 of this chapter, establish guidelines for financial eligibility for the program, which must be based on financial need.
    2. (2) Collaborate with health care providers to notify a prospective participant about the program.
    3. (3) Provide written notice to a prospective participant on the:

      1. (A) requirements described in this section;
      2. (B) nature and availability of financial support provided under the program; and
      3. (C) program's financial eligibility guidelines.
    4. (4) Receive and review applications for participation in the program.
    5. (5) Establish a process for awarding payments.
    6. (6) Subject to approval by the organization or entity, provide payment to a participant for reasonable costs incurred by the participant while participating in a cancer clinical trial, including costs for the following:

      1. (A) Travel.
      2. (B) Lodging.
      3. (C) Parking and tolls.
      4. (D) Other costs, as determined by the organization or entity.
    7. (7) Comply with all applicable state and federal laws.
  2. (b) An organization or entity that establishes and administers a program may, in addition to payments provided to a participant, provide to one (1) individual, including a relative or friend, designated by a participant payment for reasonable costs described in subsection (a)(6) incurred while the individual attends a cancer clinical trial to support the participant.
