1. (a) A person who violates:

   1. (1) any provision of this chapter; or

   2. (2) a rule or standard adopted by the state department under section 6 of this chapter;

      is liable for a civil penalty not to exceed twenty-five thousand dollars ($25,000) per day for any violation.

2. (b) The state department may:

   1. (1) recover the civil penalty described in subsection (a) in a civil action commenced in any court with jurisdiction; and
   2. (2) request in the action that the person be enjoined from continuing the violation.
