1. (a) Except as provided in subsection (b), a person may not apply unmanipulated organic fertilizer to frozen or snow covered ground as follows:

   1. (1) Within two hundred (200) feet of surface water.
   2. (2) Within a floodway.
   3. (3) In an amount that exceeds fifty percent (50%) of the agronomic rate for the planned crop.

   4. (4) With greater than two percent (2%) slope unless the ground has:

      1. (A) at least forty percent (40%) crop residue; or
      2. (B) a vegetative cover crop.
2. (b) A person is not prohibited from applying unmanipulated organic fertilizer under this section if the unmanipulated organic fertilizer is applied by means of injection or same day incorporation.
