Fertilizer material distributed for the purpose of producing an agricultural crop must be distributed:

1. (1) by a person that has a valid fertilizer business license; and

2. (2) to a person that has a valid:

   1. (A) fertilizer business license;
   2. (B) commercial applicator license; or
   3. (C) private applicator certification.
