The following may form an association under this chapter:

1. (1) Five (5) or more persons engaged in the production of agricultural products.

2. (2) Two (2) or more associations that:

   1. (A) are:

      1. (i) organized under or governed by this chapter; or
      2. (ii) organized under any other Indiana law or under the laws of any other state or territory of the United States or of the District of Columbia; and

   2. (B) are operated on a cooperative basis for the mutual benefit of the associations' members, members and patrons, or patrons as producers or associations of producers.
