The commission:

1. (1) may refuse to issue a permit to an operator whose permit the commission has repeatedly suspended for noncompliance or violation of:

   1. (A) this chapter; or
   2. (B) IC 13-4-6 (before its repeal); and

2. (2) shall refuse to issue a permit to an operator whose permit has been revoked more than three (3) times.
