A structure, an obstruction, a deposit, or an excavation described in section 20(2) of this chapter is a public nuisance. The director may commence, maintain, and prosecute an appropriate action to enjoin or abate a nuisance, including the following:

1. (1) Any of the nuisances described in section 20(2) of this chapter.

2. (2) Any other nuisance that:

   1. (A) adversely affects flood control or the safety of life or property; or

   2. (B) is unreasonably detrimental to fish, wildlife, or botanical resources.
