1. (a) This section applies to real property:

   1. (1) for which the state has the custody, management, possession, or control; and
   2. (2) in which the state has a right, a title, or an interest.

2. (b) The state may, with the written approval of the governor, give, grant, and convey to any person:

   1. (1) easements;
   2. (2) rights-of-way; and

   3. (3) the right and privilege;

      to construct, erect, maintain, operate, and use any works or structures in connection with flood control or water resources on and in the real property.
