A person who knowingly rides or drives upon or over a levee constructed under law, except for the purpose of:

1. (1) passing over the levee:

   1. (A) at a public or private crossing; or
   2. (B) upon a part of a public highway; or

2. (2) inspection or repair;

   commits a Class B infraction.
