This section and sections 2 through 5 of this chapter do not apply if:

1. (1) the Wilbur Wright memorial is transferred to the Wilbur Wright Birthplace Preservation Society after June 30, 1995; or

2. (2) the board of trustees of the Indiana state museum and historic sites corporation ( IC 4-37-2-1 ) declares the memorial to be surplus to the needs of the state museum and historic sites corporation.
