Upon:

1. (1) the declaration of the commissioner organizing a district;
2. (2) the qualification of the board; and

3. (3) the election of a president, a treasurer, and a secretary;

   the district may exercise in the district's own name, as a municipal corporation, all the rights, powers, and duties conferred upon the district by this article.
