The state or a unit of local government may commence a civil action against an owner or operator of a facility for failure to do any of the following:

1. (1) Provide notification to the emergency response commission under section 3 of this chapter.
2. (2) Submit a material safety data sheet or a list under section 8 of this chapter.
3. (3) Make available information requested under section 8 of this chapter.

4. (4) Complete and submit an inventory form under section 9 of this chapter containing tier I information unless the requirement does not apply under section 9(b) of this chapter.
