If an emergency exists, the county executive of a county may, by resolution or order:

1. (1) waive the prohibition under section 2 of this chapter; and

2. (2) allow vegetative matter resulting from landscaping maintenance and land clearing projects to be deposited in the solid waste landfill;

   for not more than ninety (90) days.
