1. (a) The department may inspect a vehicle for the purpose of determining compliance with this chapter.

2. (b) The department may:

   1. (1) inspect a vehicle that is not moving; and

   2. (2) not stop a vehicle that is in motion on a public highway (as defined in IC 9-25-2-4 ) only to conduct an inspection;

      under subsection (a).
