Ind. Code § 13-18-3-2.1

Deadline for department to complete antidegradation review in certain circumstances; extension

  1. (a) If:

    1. (1) a discharge results from an activity for which:

      1. (A) an NPDES permit subject to IC 13-15-4-1 (a)(2)(B), IC 13-15-4-1 (a)(3)(B), or IC 13-15-4-1 (a)(4); or
      2. (B) a modification or renewal of a permit referred to in one (1) of the sections referred to in clause (A);

        is sought; and

    2. (2) the permit application or application to modify or renew the permit proposes a new or increased discharge that would result in a significant lowering of water quality as defined in IC 13-18-3-2 (l)(1);

      the deadline for the department to complete the antidegradation review under 40 CFR 131.12 and 40 CFR Part 132, Appendix E with respect to the discharge is the deadline for the commissioner to approve or deny the NPDES permit application under IC 13-15-4-1 .

  2. (b) The commissioner may extend for cause for not more than ninety (90) days the deadline under subsection (a) for the department to complete the antidegradation review.
