1. (a) The commissioner may suspend or revoke the certificate of an operator issued under this chapter if any of the following conditions are found:

   1. (1) The operator has practiced fraud or deception in any state or other jurisdiction.
   2. (2) Reasonable care, judgment, or the application of the operator's knowledge or ability was not used in the performance of the operator's duties.
   3. (3) The operator is incompetent or unable to properly perform the operator's duties.

   4. (4) A certificate of the operator issued:

      1. (A) under this chapter; or

      2. (B) by any other state or jurisdiction for a purpose comparable to the purpose for which a certificate is issued under this chapter;

         has been revoked.

   5. (5) The operator has been convicted of a crime related to a certificate of the operator issued:

      1. (A) under this chapter; or
      2. (B) by any other state or jurisdiction for a purpose comparable to the purpose for which a certificate is issued under this chapter.

2. (b) A person aggrieved by the revocation or modification of a certificate of an operator may appeal the revocation or modification to the office of administrative law proceedings under IC 4-21.5-3 .
