1. (a) A person may not start:

   1. (1) construction of a confined feeding operation; or

   2. (2) expansion of a confined feeding operation that increases:

      1. (A) animal capacity; or
      2. (B) manure containment capacity; or

      3. (C) both;

         without obtaining the prior approval of the department.

2. (b) A person may not operate a confined feeding operation without obtaining the prior approval of the department.
