- (a) As used in this chapter, "home and community based services waiver" refers to a federal Medicaid waiver granted to the state under 42 U.S.C. 1396n(c) to provide home and community based long term care services and supports to individuals with disabilities and the elderly.
- (b) The term does not include home and community services offered as part of the approved Medicaid state plan.
