1. (a) Not later than September 1, 2026, the office of the secretary shall apply to the United States Department of Health and Human Services for an amendment to the Medicaid home and community based services waiver concerning the provision of services to individuals who:

   1. (1) are at least sixty (60) years of age;
   2. (2) meet nursing facility level of care requirements; and

   3. (3) are not transferring to the waiver from another home and community based services waiver;

      to establish an individual cost limit of not more than the institutional cost of nursing facility services.

2. (b) This section expires July 1, 2028.
