1. (a) This section applies to a home health agency that is:

   1. (1) licensed under IC 16-27-1 ;
   2. (2) enrolled as a Medicaid provider; and
   3. (3) in good standing as a Medicaid provider, as determined by the office of the secretary.

2. (b) Notwithstanding any other law, rule, or bulletin, a home health agency licensed under IC 16-27-1 may continue to provide services to a Medicaid recipient and receive Medicaid reimbursement for the services while the home health agency's application for Medicare enrollment is pending if the home health agency:

   1. (1) submitted a Medicare enrollment application to the federal Centers for Medicare and Medicaid Services; or

   2. (2) initiated the enrollment process with a federal Centers for Medicare and Medicaid Services approved accrediting organization;

      before April 1, 2026.
