1. (a) This section applies upon the death of either of the following:

   1. (1) A recipient who is receiving assistance as a dependent child.
   2. (2) A parent of the recipient.

2. (b) Unless otherwise determined by the director, the division shall pay one thousand two hundred dollars ($1,200) for the funeral director's expenses of the decedent if the following conditions exist:

   1. (1) The estate of the deceased is insufficient to pay the funeral director's expenses.

   2. (2) The person legally responsible for the burial of the deceased is unable to pay the funeral director's expenses.
