If an employer fails to comply with sections 1 and 2 of this chapter, an employee may:

1. (1) bring an action at law for damages for the employer's noncompliance; or

2. (2) apply to the circuit court, superior court, or probate court for equitable relief that is just and proper under the circumstances.
