1. (a) Except as provided in subsection (b), a SECTION of HEA 1003-2024 does not apply to an administrative proceeding or a proceeding for judicial review pending on June 30, 2024.

2. (b) A SECTION of HEA 1003-2024 applies to:

   1. (1) an administrative proceeding or a proceeding for judicial review commenced after June 30, 2024; or
   2. (2) an administrative proceeding conducted after June 30, 2024, on remand from a court.
3. (c) After June 30, 2024, any reference to a duty of an ultimate authority with respect to an administrative proceeding or proceeding for judicial review shall be construed as a duty of the office of administrative legal proceedings if the office of administrative legal proceedings is the ultimate authority for that agency.
