The General Assembly hereby finds and declares that:

1. (1) the health care professional-patient relationship is paramount and should not be subject to third-party intrusion;
2. (2) prior authorization programs shall be subject to member coverage agreements and medical policies but shall not hinder the independent medical judgment of a physician or health care provider; and
3. (3) prior authorization programs must be transparent to ensure a fair and consistent process for health care providers and patients.
