a) No person may act as a pilot or required crewmember of a civil aircraft:

1. 1) within eight hours after the consumption of any alcoholic beverage;

2. 2) while under the influence of alcohol;

   1. 3) while using any drug that affects his faculties in any way contrary to safety; or
   2. 4) while having .04 percent by weight or more alcohol in the blood. (See Section 43(d) of the Act.)
   3. b) Except in an emergency, no pilot of a civil aircraft may allow a person who appears to be under the influence of intoxicating liquors or drugs (except a medical patient under proper care) to be carried as a passenger in that aircraft.
