Whenever it appears to the Department that a person has engaged or is engaged in any act or practice constituting a willful violation of any provision of the MCSR or of any settlement agreement or order issued thereunder, the Secretary shall request the Illinois Attorney General or State's Attorney to bring an action in the appropriate Circuit Court for such relief as is authorized by the Law.
