1. a) This Part applies to the following actions by motor carriers of property:

   1. 1) The leasing of equipment with which to perform transportation regulated by the Illinois Commerce Commission ("Commission").
   2. 2) The interchange of equipment between motor common carriers in the performance of transportation regulated by this Commission, except with regard to equipment used exclusively to provide transportation within counties having a population in excess of 1,000,000 persons.

2. b) This Part does not apply to the following actions:

   1. 1) The leasing of equipment by persons whose principal business is the leasing of equipment, without drivers, for hire, to the general public; and
   2. 2) The leasing of equipment for use in interstate commerce.
3. c) The leasing of equipment with drivers to other than a licensed motor carrier of property is prohibited by Section 18c-4103(1) of the Illinois Commercial Transportation Law ("Law") (Ill. Rev. Stat. 1985, ch. 95½, par. 18c-4103(1)).
